These Terms of Use (‘Terms’) are a legally binding contract between you (‘User’ or ‘you’), the user of the GenieSign website (‘Website’) and us, GenieSign (‘we’, ‘GenieSign’, ‘Company’, ‘us’). 

The Terms govern your rights and responsibilities regarding your use of the Website and the services we provide via the Website, including our employee onboarding and e-signature services, as well as communication through WhatsApp. We invite you to carefully read these Terms before using our website and services. 

By accessing our website or using our services, including through WhatsApp, you agree to be bound by the Terms. When you create an account, we will additionally request your explicit consent to these Terms. If you do not agree to the Terms, you should not use the Website or our services.

Privacy and Communications

GenieSign is committed to protecting your privacy. To understand how we collect and process your personal data, please refer to our Privacy Policy. 

By using our services, you agree to receive electronic communications from us. These may include notifications about updates, regulatory disclosures, changes in the Terms, privacy policies, and billing statements. Communications will primarily be sent via email or through WhatsApp messages. You acknowledge that these electronic communications satisfy legal requirements for written communication. 

You are responsible for keeping your contact details, especially your email and phone number, updated. Failure to respond to communications from us within 2 business days regarding violations, disputes, or complaints may result in suspension or termination of your access to our Services. 

You may also receive newsletters and other communications. You can opt-out of marketing emails at any time by clicking the “Unsubscribe” button included in each email. 

Free Trials and Purchases

Your Account:

To access our Services, you need to create an account. During registration, we may ask for your name, email address, email client, company size, industry, and position. You may also provide your phone number at your discretion. You are responsible for maintaining the security of your account information. You can delete your account at any time, but if you change your mind, you may restore it within 30 days.

Free Services:

You may user our free trial for up to 14 days days for free.

Subscription Plans:

Certain Services require a subscription. Subscription details, including plans and pricing, are available on our website. We may modify subscription terms or introduce new plans at any time, but this will not affect existing subscriptions within the prepaid period.

Payment for Subscriptions:

Your access to Services under a subscription will be activated only after full payment. Payments are processed by a third-party payment intermediary, not GenieSign, so please review their terms and privacy policies.

Subscriptions will automatically renew unless canceled or changed prior to the renewal date. By making a payment, you authorize GenieSign (or our payment intermediary) to charge your payment method for recurring payments. 

Renewals

By default, subscriptions are automatically renewed, and the respective payments are charged on a recurring basis. If we discontinue your current subscription or change the terms, we will offer a similar subscription. You will be notified in advance of any changes, and if you do not wish to renew, you must contact us via email at support@geniesign.io. 

Refunds

Refunds are only available in exceptional circumstances, such as technical issues preventing you from using our services within 7 days of your first subscription payment. Requests for refunds should be sent to support@geniesign.io. After the refund period, you cannot receive a refund for services used, including any recurring payments. 

Refunds will not be issued if: 

  • You made a mistake when using our services. 
  • You lack the expertise to use the services. 
  • You changed your mind about using our services. 
  • You violated these Terms. 

Intellectual Property

All content on the Website, including software, designs, logos, trademarks, and other materials, are the intellectual property of GenieSign and its partners. 

Subject to these Terms, GenieSign grants you a limited, non-exclusive, non-transferable license to use its intellectual property solely for your personal or business use in accordance with your subscription plan. You may not remove or alter copyright or proprietary notices. 

You remain the owner of any intellectual property you upload or create using our services. However, by uploading content, you grant GenieSign a license to use this content as necessary to provide our services and for marketing purposes, with your consent obtained beforehand for any marketing use. 

Warranties and Representations

You represent and warrant that: 

  • You have full legal capacity to enter into these Terms and use our Services. 
  • You are authorized to represent any organization you sign up for on behalf of. 
  • Any content you submit to GenieSign is accurate, does not violate intellectual property rights, and you are authorized to upload it. 
  • You will not exploit our services for commercial purposes without explicit consent. 

Disclaimers and Liability

You use our services at your own risk. The services are provided “as-is,” and GenieSign makes no warranties regarding their functionality, accuracy, or completeness. We are not liable for any damages arising from the use of our services or any third-party websites linked to our platform. 

We are not responsible for any loss or damage caused by unauthorized access to your account, and we limit our liability to the total amount you paid for services in the preceding 12 months. 

Other Provisions

We may modify or suspend our services at any time. If the Terms change, you will be notified in advance via email. 

We reserve the right to terminate your access to our services if you violate these Terms or engage in misconduct.
